By creating an account or using Behajour ("the Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you ("User") and Behajour ("Company," "we," "us," or "our").
Behajour is an AI-powered advertising account intelligence platform that analyzes advertising data, generates optimization recommendations, produces performance reports, and assists with ad copy creation. The Service uses artificial intelligence and machine learning technologies, including third-party AI providers, to process your data and generate outputs.
3.1 All AI-generated outputs are provided for INFORMATIONAL PURPOSES ONLY. They do not constitute professional advertising, financial, legal, or business advice.
3.2 You are solely responsible for reviewing, verifying, and validating all AI-generated recommendations before implementing them in your advertising campaigns or making any business decisions based on them.
3.3 The Company is not responsible for any losses, damages, or adverse outcomes — including but not limited to lost ad spend, lost revenue, account suspensions, or missed opportunities — resulting from your use of or reliance on AI-generated content produced by the Service.
4.1 You agree to use the Service only for lawful purposes and in accordance with these Terms.
4.2 You are responsible for the accuracy and legality of all data you upload to the Service, including advertising data, CSV files, and screenshots.
4.3 You must have the legal right to upload and process any data you provide to the Service. Do not upload data that you do not have permission to use.
4.4 You agree not to use the Service to upload, store, or process personally identifiable information (PII) of individuals without appropriate legal basis and consent.
4.5 You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
5.1 The Service, including its software, algorithms, design, and content, is owned by the Company and protected by intellectual property laws.
5.2 You retain ownership of all data you upload to the Service. By uploading data, you grant the Company a limited, non-exclusive license to process your data solely for the purpose of providing the Service to you.
5.3 AI-generated outputs produced by the Service using your data are provided to you for your use. The Company does not claim ownership of outputs generated specifically from your data.
6.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, OR LOSS OF BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
6.2 THE COMPANY'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE COMPANY IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
6.3 The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any data you upload to the Service.
8.1 We use third-party AI providers (including Anthropic) to process data and generate outputs. By using the Service, you acknowledge that your data may be processed by these third-party providers subject to their own terms and privacy policies.
8.2 We implement reasonable security measures to protect your data, but we cannot guarantee absolute security. You upload data to the Service at your own risk.
9.1 Access to certain features of the Service requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis.
9.2 All fees are non-refundable except as required by applicable law or as explicitly stated in our refund policy.
9.3 We reserve the right to modify pricing with 30 days advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
10.1 You may terminate your account at any time by contacting us or through the account settings.
10.2 We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or any other reason at our discretion, with or without notice.
10.3 Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable retention period.
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Texas.
